i would like to know the implications. we would like to maintain our religion. also, if a nikaah is done and after that we marry under the act as muslim and christian, will this be possible? Can a muslim man and a christian girl marry under the special marriage act? what are the implications?
Why are you in doubt regarding this issue as you know about this Act %26amp; the marriage under this Act ? The implication will be that you both remain Muslim %26amp; Christian even after the marriage %26amp; no change of religion required for such marriage. As far the religion of the children borne out of this marriage can be decided by you both mutually or leave it to them to do as they wish %26amp; follow when they growup. You both belonging to different religion can marry in the court without changing your individual religion. Court marriage as you call it is solemnized under the Special Marriage Act, 1954 all such marriages can take place between any two Indian citizens as well one Indian citizen with a foreigner irrespective of their religion, caste or creed, and you can say this is the secular form of marriage available in our country. Such a marriage is solemnized before the marriage officer/registrar usually D.C. deputy commissioner of the area /SDM where both or any of the parties to such a marriage reside permanently or for at least one month. Cost of such a marriage as the rate prevalent in your area. Now how you proceed? Both the parties to the marriage file a joint application before the marriage officer along with individual affidavit attested by notary public specifying the age(boy 21yrs %26amp;girl 18yrs), place of residence, marital status(unmarried or divorcee as the case maybe), mental status(not idiot or not with unfit mind), not related to each other. Along with this you have to give proof of age (School certificate, Passport, Pan card), proof of residence (Passport, ration card, voters ID card, rent agreement), %26amp; the application of such a marriage should be witnessed by 3 independent adult persons, affix one photograph of each of the parties %26amp; all the 3 witnesses. You have made such an application/notice to the marriage officer in person along with all the 3 witnesses. On receiving such an application the marriage officer issues a month notice regarding the intended marriage %26amp; get such a notice affixed on the notice board out side his office, a copy of such notice is sent to the marriage officer under whose jurisdiction the other party lives, also a copy is to the individual parties address. After expiry of the period of notice a date is fixed on which all the persons parties to the marriage %26amp; 3 witnesses appear again before the marriage officer who declare them married %26amp; issue a certificate to this regard. Incase of any objections raised the marriage officer will settle these objections. Now what can be objections that can be raised? These can ONLY BE REGARDING THE CONDITIONS NECESSARY FOR SUCH MARIAGE %26amp; NOTHING ELSE. What are the conditions? As I stated above i.e. Age, martial status, mental status, prohibited relationship (related to each other by blood). This is the brief %26amp; general procedure I have told you here. Can a muslim man and a christian girl marry under the special marriage act? what are the implications?
ya, you can do as indian marrige ACt
GO TO,PAKISTAN AND DO IT THERE.
indian constitution does not bar marriage on the basis of cast and creed. u r absolutely free. but there are self styled social leaders and family members who cannot tolerate such things and make the case very unpleasant and nasty.
If you are a Muslim, you should know that it is completely right for a Muslim-man to get married to a Christisan-girl - because, according to the Holy Koran, Christians and Jews are both considered to be the People-of-the-Book.
The Indian Muslim Personal Law, recognised by the Government of India, permits such type of marriage.
My sister and brother-in-law did this. Neither are exceptionally religious though but the ceremony had both a Christian an Muslim person to lead the wedding. I don't know much about the Islamic wedding specifics but my sister said they did not do the extended traditional aspects to keep all in attendance from having to ';endure'; essentially two ceremonies.
** Edit **
The only point of caution I would recommend for any couple in cross religion relationships is that they carefully think about how to handle the religious upbringing of children. The problem isn't so much from the couple themselves but more from the other family members. I've also seen where my nephew can be a bit confused about Christmas dinner at Grandma's house where a ham is usually served but fortunately a side of lamb is also prepared and he can eat that.
For the sake of the children that you would be blessed with one of you should convert to the other religion.
There is nothing wrong in keeping to you own, but it is a ideal situation and anything that is 'ideal' always fails the test when faced with 'reality'.
In christianity its possible. But no idea about Islam.
They can do it under special marriage Act, and you can claim protection under section 506 IPC
