The problem is that ';marriage'; is a legal definition.
I have gravel in my front yard.
Suppose I use the rocks to pay my rent, claiming that each rock is a dollar. I give my landlord 1000 dollar/rocks and consider my rent paid.
Think he'd accept that? No? Why? Because the ';dollar'; has a legal definition. I can't call it a dollar unless it really is a dollar.
We just said that you can't call it a marriage unless it's a marriage.
AND we already have moral definitions in marriage.
You can't marry your house, your horse or your elbow. You can't marry someone without their consent. They must be of legal age.
You can't marry someone if you're already married.
And now: You can't ';marry'; someone of the same sex.

So you are saying that 9 people who were not voted in by the people should get to make decisions for 270 million? You may not weigh all the factors, but I can assure you that I do. Homosexuality is a sin. Just like all the other sins I commit on a daily basis. The problem is that no one is trying to say that lying, jealousy, gluttony, lust or any other sin is perfectly normal. By legalizing gay marriage, you tell our kids that it is perfectly normal. I'm all for allowing civil unions, giving them benefits, etc. Just don't tell my children that the bible was wrong when it said that marriage is a special bond between a husband and wife.
The people make the laws not the courts. That would be legislating from the bench, a no no.
The court is to enforce the laws the people make.
A government OF THE PEOPLE, BY THE PEOPLE AND FOR THE PEOPLE.
Notice the PEOPLE part.
The courts are not there to usurp the will of the people. They should judge the constutionality of a law ON LY.
It shouldn't be in the hands of ANY part of the government, including the courts.
Only in a Democracy.
The job of the courts is to interpret laws, not make them.
should it left up to gay people too change the meaning of marriage without comment from the society that owns it?
