What legal reasons are there to ban gay marriage?

Ok, ive asked this question in the politics section and no one had an answer other than basically saying that they hate gay people. I want to know a LEGAL reason. I DON'T CARE WHAT YOUR OPINION IS ON GAY PEOPLE. I simply want a legal basis for the conclusion that gay marriage can be banned. i'm sorry but again i will repeat, I DONT CARE I F YOU HATE GAY PEOPLE.What legal reasons are there to ban gay marriage?
It's not really a legal issue, it;s one of opinion and prejudice.





Essentially, currnet marriage laws in many places do not provide for a same sex union, but nor do they explicitly bar it. So in a legal sense, a jurisdiction either has to specifically ban same sex 'marriage', or it has to provide some legal definition which explicitly defines marriage as involving one person from each sex.





But as I say, it's not about the law, it's about religious based intolerance.What legal reasons are there to ban gay marriage?
I think the question shows that you don't understand the subject.





Banning Gay Marriage would be a legal decision, one made by a Legislature. There don't have to BE any legal reasons.





What I'm trying to make clear is not connected to the question being Gay Marriage. Speed Limits don't have ';legal reasons.'; They are legal DECISIONS. The ';legal reason'; you get a ticket when you drive too fast is because the law says so.





An example of a ';legal reason'; would be in a decision to NOT issue a marriage certificate to a same sex couple, ';BECAUSE the law does not recognize same sex marriage.';





Your question therefore makes no sense. Perhaps you are looking for just ';reasons to ban gay marriage,'; but in that case, your answer would include the individual dislikes for Gays, and you have to accept that as the individual's reason.





For the record, I am neither for nor against ';gay marriage,'; I'm just against the decision being made anywhere but state legislatures or state voter referenda.
gay marriage is not illegal. Marriage is supported by certain special privileges and benefits. It's just like farming for example. Farmers get special tax benefits and privileges but in order to be eligible, a person claiming to be a farmer must meet certain criteria. I call myself a farmer but I don't farm enough land so the government won't call me a farmer for receiving any benefits.





Gay marriage doesn't meet the definition of marriage to receive special benefits. There are many people who are in committed, long term, loving relationships who also do not get any benefits.
Our courts and legislatures, and the U.S. Supreme Court, look to our legal traditions for guidance in deciding cases and crafting laws. Our law comes from many sources, including the ecclesiastical (church) law of the middle ages, which did not recognize gay marriage.
Because most laws are made from the will of the people, and the people will it not to happen.
